The California Public Utilities Commission (CPUC) is holding its first Public Participation Hearing in San Diego on how much the captive ratepayers of SCE and SDG&E should pay for the defective San Onofre Power Plant! The Coalition to Decommission San Onofre (CDSO), a volunteer grassroots organization representing the interests of the 8.5 million people living within 50 miles of this defunct nuclear power plant/waste dump, recently submitted the following testimony in this Investigation [http://www.copswiki.org/w/pub/Common/M1383/CleanI1210013CDSOP2Testimony.pdf]

  • The San Onofre Nuclear Power Plant was not "used and useful" at any time after the emergency shutdown on January 31, 2012. Furthermore, as soon as the Root Cause Analysis had been completed by SCE for both Units 2 and 3 on May 7, 2012, it should have been clear to any reasonable manager that the plant would never run again. The U.S. Nuclear Regulatory Commission just published its finding that SCE failed to identify a flawed design for four replacement steam generators, which led to excessive wear to hundreds of tubes that carried radioactive water. http://sanonofresafety.files.wordpress.com/2011/11/ml13263a271-so-inspectionreport2013-09-20.pdf

  • CDSO argued in Phase 1 of this CPUC Investigation that SCE did NOT exercise reasonable managerial skill in designing, fabricating, installing and troubleshooting the Steam Generator Replacement Project (SGRP) and related High Pressure Turbine (HPT) project and Phase 3, the Reasonableness Review of the SGRP, remains to be conducted. Therefore, the CPUC has no basis on which to make the findings proposed by SCE and SDG&E in Phases 1 or 2 of the Investigation.

  • The calculation of net investment in fixed assets should be based on the plant without the defectively designed and failed SGRP and systems replaced contingent upon it. As a rough estimate, the base plant value, not including these failed/superfluous systems is about $1,241 - $768 [SGRP] - $24 [HPT] = $449 million net investment in the core plant. The difference between $1,241 and $449 represents the loss incurred by the failure of the SGRP and should be resolved between SCE and Mitsubishi Heavy Industries, and any insurance, with the rest covered by shareholders (through loss of their equity).

  • Any remaining assets not already been fully depreciated should be depreciated at a rate to allow investors to recover their investment but not enjoy a return on the investment due to the inherent risk involved in such investments. Allowing investors to be risk-free in their investment continues to incentivize monopoly utilities to develop failed projects that run only for a short time, so they can have the entirety of their investment returned plus an ROI and have it returned faster than the normal depreciation schedule. This is extremely counterproductive regulatory policy which has been fully exposed by the magnitude of this failed SGRP and its consequent costs. The CPUC needs no further reason to recognize this and cease repeating this perverse policy.

  • San Onofre should be removed from the rate base at the earliest date allowed under Public Utilities Code Section 455.5: November 1, 2012; and all activities subsequent to November 1, 2012, considered "decommissioning" as the plant is no longer used and useful. The defectively-designed and failed Steam Generator Replacement Project and related High Pressure Turbine project should be treated as abandoned plant, and therefore, shareholders should not recover their equity nor any return on their equity investment on them.

The Investor-Owned Utilities who are the gatekeepers to our transmission grid and generation resources do NOT need any more help from this Commission. We ratepayers who fund their lavish compensation and can barely support ourselves, our families, and our small businesses, DO. To wit …

  • The electricity rates paid by the captive customers of the SCE and SDG&E monopolies are 50% higher than those paid in the two largest municipal electric utilities in California (L.A. and Sacramento)

  • SCE is writing down San Onofre Nuclear Generating Station Units 2 and 3 on its books, and reported a 43% increase in year-to-date core earnings for 2013 over 2012.

[SDCPJ] Extraordinary Opportunity: Malalai Joya in San Diego

From October 21 – 23 you have the extraordinary opportunity to meet and hear from one of the most exceptional women of the world to come out of the last decade. Malalai Joya will visit five venues in the San Diego region per the detailed schedule below, ending on October 23 at 7 PM at the Church of the Brethren, sponsored by the San Diego Coalition for Peace & Justice. 
 
Malalai Joya, now 34, comes out of the war and occupation-torn maelstrom of Afghanistan.  She served as a 2003 elected delegate to the Loya Jirga that convened on the Constitution of Afghanistan, and in 2007 became one of 68 women elected to the 249-seat National Assembly, or Wolesi Jirga, as the youngest member of that Afghan parliament.  In 2003 and again in 2007 she spoke out against former warlords and war criminals in the Afghan parliament, and because of this stance was suspended from the parliament. Since then she has survived six assassination attempts. She travels in Afghanistan with armed guards and has worked tirelessly on behalf of Afghan women and to end the occupation of her country. 
 
In 2010, Time Magazine placed Malalai Joya on their annual list of the 100 most influential people in the world.  Foreign Policy Magazine listed her in its annual list of the Top 100 Global Thinkers. In March, 2011, The Guardian listed her among the "Top 100 women activists and campaigners." Her book, A Woman Among Warlords: The Extraordinary Story of an Afghan Who Dared to Raise Her Voice, was published by Scribner in the U.S.

The defectively-designed and failed Steam Generator Replacement Project and related High Pressure Turbine project should be treated as abandoned plant, and therefore, shareholders should not recover their equity nor any return on their equity investment on them.

The Investor-Owned Utilities who are the gatekeepers to our transmission grid and generation resources do NOT need any more help from this Commission. We ratepayers who fund their lavish compensation and can barely support ourselves, our families, and our small businesses, DO. To wit …

• The Houston Chronicle reported that the average annual compensation of utility executives nationwide increased 150% from 2000 - 2011. In Southern California, it is even more egregious -- the annual compensation for the Chair & CEO of SCE increased 15 times from 2000 - 2011, from $764k to 10.9 Mil; and that for the SDG&E Chair/CEO increased a mere 4 times in the same time period, from almost $1 Mil to $3.9 Mil.http://www.chron.com/news/energy/item/Electric-Utility-Executive-Compensation-13532.php?appSession=003978379741089

• The electricity rates paid by the captive customers of the SCE and SDG&E monopolies are 50% higher than those paid in the two largest municipal electric utilities in California (L.A. and Sacramento)

As the community continues to celebrate the closure of the San Onofre nuclear power plant, there is recognition that the job is not over, and now a struggle to decommission the plant now begins, along with the need to carefully monitor the use of nearly $4 billion in decommissioning funds, so that the plant is returned to its former state.

CORE MESSAGE OF Coalition to Decommission San Onofre:

We are here today in the hope that the Nuclear Regulatory Commission (NRC) will make San Onofre the "Flagship Project" for a safe-and-sane cleanup of America's old and dangerous nuclear fleet and its highly radioactive nuclear waste problems. The original Manhattan Project brought us to where we are now; it's time for the same kind of resources and energy to be put into a project to rid of us this dangerous radioactive waste.

To this end the Coalition to Decommission San Onofre is forming a true citizens' oversight committee to watch out for the health and safety of all Californians and workers at the plant during the decommissioning process, and to monitor the cost of decommissioning so the citizens and ratepayers of California are fully represented during the process.

1. The Coalition to Decommission San Onofre asks the NRC to give us official status in order to ensure that the public will have an opportunity to review and comment on significant decommissioning plans, including planned expenditures.

2. Coalition members learned recently from the NRC that high burnup fuel* has been used at San Onofre since 1996. But we have been unable to find a public notice of that from the NRC or SCE. Even the union and other workers we have contacted were not aware of its use. Was a notice ever given to the public and workers? Were workers made aware that this high burnup fuel is more than twice as radioactive?

* High burnup fuel is hotter and "between 2 and 158 times more radioactive", requiring the waste to be cooled on-site in spent fuel pools for at least 12-15 years (rather than 5 years).

3. The Coalition wants to know how the high burnup fuel may impact the decommissioning process at San Onofre. What specific problems does this higher radioactive fuel present for waste storage in fuel pools and dry cask storage at San Onofre and just how much longer will this radiation last? How will decommissioning be impacted by the current onsite storage of the spent fuel at San Onofre? 

4. Coalition members also learned recently that some NRC staff are worried about short and long-term waste storage in dry cask of high burnup fuel, and have initiated a new study to determine if it can safely be stored in dry casks. When will this NRC report be complete? Will it be released public and when? The Coalition has learned that there appears to be no way to monitor what's occurring to the spent fuel assemblies stored inside the dry casks. How does the NRC propose to monitor the condition of the highly radioactive material stored inside dry casks? How many casks will be required to safely store all the high burnup fuel that is on site in both the spent fuel pools and dry casks at San Onofre? How much high burn up fuel is on site in spent fuel pools and in dry cask storage at San Onofre

Donna Gilmore of San Clemente says "I was shocked to learn San Onofre, as well as other plants in California and around the country, have been using high burnup fuel that is over twice as radioactive and has no approved short or long term safe storage solution."

Gene Stone of Residents Organized for Safe Environment (ROSE) says "we may be a little safer with San Onofre closed, but we are not safe yet.

To help inform ratepayers and the general public about the issues affecting the decommissioning process at San Onofre, the Coalition to Decommission San Onofre will sponsor a Community Symposium on Decommissioning San Onofre, Saturday, October 19, 2013 1:30 p.m to 4:30 p.m. at the Center for Spiritual Living,1201 Puerta Del Sol, Suite 100, San Clemente, CA 92673.

Featured speakers will include Arjun Makhijani, expert on Hardened On Site Storage of nuclear waste and long-term high-level waste management issues and President of the Institute for Energy and Environmental Research, and Marvin Resnikoff, expert on nuclear waste management issues and Senior Associate at Radioactive Waste Management Associates.
