Published at Allvoices.com Army Private Bradley Manning recently informed the military court that he was, in fact, the source of information published by WikiLeaks. While the 24 year old Intelligence Analyst, effectively, took responsibility for transferring classified documents, in violation of military regulations, he maintained that he was not guilty of all 22 charges against him. "PFC Manning has offered to plead guilty to various offenses through a process known as "pleading by exceptions and substitutions," explained Manning civilian defense attorney David Coombs on his blog. Manning is "attempting to accept responsibility for offenses that are encapsulated within, or are a subset of, the charged offenses…. PFC Manning is not pleading guilty to the specifications as charged by the government," added Coombs. Nor is he "submitting a plea as part of an agreement or deal with the government." "Pleading by exceptions and substitutions" is very rare--so rare that most observers of the proceedings were thoroughly confused. Some media outlets incorrectly reported that Manning was "seeking a deal", "pleading guilty", or trying to nullify a life sentence--or even the death penalty. It's important to clarify that no deal is being sought, Manning no longer faces the death penalty, and his plea doesn't prohibit the maximum sentence of life in prison. Manning's plea confused many, simply because the truth isn't usually offered up in such proceedings without something in return. But that is what happened. Why would Manning accept responsibility? Manning needed to accept responsibility, so that he could move forward with his defense as a whistle-blower, ahead of the scheduled, February 4, 2013, start of his court martial at Fort Meade, Maryland. Supporters of Manning have long hailed him as a young man, with a conscience, who heroically uncovered evidence of war crimes and government corruption. Yet, many cling to the narrative of Manning, the disillusioned, unstable, gay soldier, serving precariously under "Don't Ask, Don't Tell". Neither the defense nor the prosecution, believe Manning's difficulties in the Army are a primary aspect of what happened. Neither side has disputed Manning's motives, as summed up in this online chat, prior to his arrest: "I want people to see the truth… because without information, you cannot make informed decisions as a public… I was actively involved in something that I was completely against." According to the prosecution, Manning also provided the following note, to WikiLeaks, when he, anonymously, uploaded a cache of battlefield reports of the Iraq War: "This is perhaps one of the most significant documents of our time… removing the fog of war and revealing the true nature of 21st century asymmetric warfare." While doing his job, Manning analyzed horrific surveillance videos of the bloody and chaotic Iraq War unfolding around him. In stark contrast to the "Aiding the Enemy" and Espionage Act violation charges the prosecution has painted him with, Manning is now free to explain how he was trying to do the right thing, expecting nothing in return, while sitting in that dark bunker at Forward Operating Base Hammer. "God knows what happens now. Hopefully worldwide discussion, debates, and reforms – if not, we're doomed," Manning allegedly told a government informant before his arrest. Now with this plea offering, he's taken responsibility on the most favorable terms available to him. At the conclusion of the "Article 32" pre-trial investigative hearing back in December 2011, Manning's attorney David Coombs explained that his goal was to show the court "why things happened, while the government was only interested in what happened." The top U.S. nuclear safety official said Tuesday the operator of the idled San Onofre nuclear plant is ultimately responsible for the ensuring the quality of equipment and work provided by vendors and contractors.

Plant operator Southern California Edison has shut down San Onofre indefinitely as it grapples with the rapid degradation of replacement steam generators that were installed in 2010 and 2011.

Addressing nuclear industry executives in Atlanta, Nuclear Regulatory Commission Chairman Allison Macfarlane touched upon challenges at the idled San Onofre nuclear station and highlighted the responsibilities of the plant license holder.

"This obligation extends to the licensees' use of vendors and contractors," McFarlane said. "The licensee is ultimately responsible for the work done by their vendors and contractors to ensure they meet our quality assurance requirements."

Edison has billed replacement steam generator manufacturer Mitsubishi Heavy Industries for $45 million in connection with the plant's nine-month outage, with costs for repairs, inspections and replacement power already exceeding $350 million.

After hiring Mitsubishi in 2004 to build and deliver four new generators, Edison audited the manufacturer's quality assurance program at facilities in Kobe, Japan. Edison repeatedly found issues associated with design control before acknowledging improvements in 2006, according to an inspection report published by the nuclear commission in July.

Edison has linked generator problems to faulty computer modeling in the design process and additional manufacturing issues. Mitsubishi has not revealed its own findings.

The nuclear commission is considering a proposal by Edison to restart the Unit 2 reactor at partial power for a five-month period before conducting further inspections.

The Unit 3 reactor appears to have more significant damage to its generators, where a tube sprung a leak on Jan. 31, prompting the shutdown. Steam generator tubes are a crucial barrier to the release of radioactive water that circulates through the reactor core. A tube rupture also can threaten the reactors cooling system.

State utility regulators opened an investigation in October into whether it is appropriate to continue billing Southern California electrical customers more than $1 billion a year for a plant no longer producing power.

Pacific Gas & Electric Co. was scrambling Monday to salvage plans to conduct seismic surveys using sonic blasts off the coast near the Diablo Canyon nuclear power plant after a state regulatory agency staff report concluded it would disturb more than 7,000 marine mammals.

The California Coastal Commission staff, in a report released Friday, recommended that the commission deny PG&E's application for a coastal development permit needed to begin the project. The staff cited "significant and unavoidable impacts to marine resources," including threatened and endangered whales, porpoises and sea otters.

The commission plans to vote Nov. 14 on PG&E's request to survey 130 square miles off the coast of Morro Bay in San Luis Obispo County with acoustic pulses capable of penetrating as much as nine miles into the seafloor.

The utility believes the seismic survey is the best way to define the amount of movement that faults in the area are capable of producing, and to develop emergency preparedness plans.

Analysis of the sonic reflections would provide detailed 3-D images of the geometry, relationships and ground motions of several fault zones near the plant, which generates enough energy to meet the needs of more than 3 million residents of Northern and Central California.

"PG&E is committed to conducting this proposed seismic research safely and in an environmentally responsible manner," spokesman Blair Jones said. The utility's plan was developed carefully in consultation with state and federal agencies, he said.

Coastal Commission staff, however, said it could not determine whether alternative, less harmful technologies are available for the survey — or whether it is needed at all.

"The staff is saying that the potential impacts of this project are so severe that a seismic survey should be the last alternative," said Alison Dettmer, the commission's deputy director of ocean resources. "Theoretically, they could come back later and apply again."

The staff's major concerns are the survey's potential effects on the basic biological functions of sea creatures in marine sanctuaries, and on a population of about 2,000 harbor porpoises that reside in and around scenic Morro Bay.

Harbor porpoises are acutely sensitive to man-made sounds. It is the species that would be most vulnerable to hearing loss and injury during the survey, which calls for a 235-foot vessel to tow a quarter-mile-wide array of submerged 250-decibel "air cannons" that would discharge every 15 seconds, night and day, for 17 days.

The entire population of harbor porpoises in Morro Bay would experience multiple disturbances and possibly be forced to move far outside their normal foraging grounds, which could threaten their survival, according to the staff report.

Overall, "more than 7,000 individual marine mammals from 17 species would be exposed to sound levels sufficient to result in some level of disturbance and behavioral disruption," the report said. In addition, the project would "result in mortality to about 5 million fish and invertebrate larvae in the project area and an unknown number of fish eggs."

PG&E said it plans to station observers certified in monitoring protected species on vessels and in airplanes to check for injured animals and carcasses. The utility said it would halt the testing if marine mammals, which rely on communication and sensing of their environment for a variety of critical life functions, venture close to the operation.

But commission staffers said that potentially high seas, windy conditions and poor night visibility "would cause these measures to be ineffective much of the time."

Michael Jasny, director of the Natural Resources Defense Counsel's marine mammal protection project, said the staff report "reflects a thorough understanding of the issues involved."

"Fundamentally, this project has not been justified along the coast where the impacts would be significant," Jasny said. "If you are going to impact the coast, you better make sure it is essential to the public welfare and there is no safer way to do it."

Irakli Kakabadaze, a participant in the Scholars at Risk program, will speak about his work as a human-rights activist.  The lecture, "The Role of Transformative Political Theater in Bringing About the Rose Revolution on Georgia," will begin at 4 p.m., Nov. 13, in Arts and Letters 101.

Irakli Kakabadaze, a writer, human-rights activist and performance artist will visit San Diego State University as the inaugural lecturer in the Scholars at Risk program.

Presented in conjunction with The Charles W. Hostler Institute of World Affairs at SDSU, Kakabadaze, a member of the Scholars at Risk network, will speak about his experiences in his home country of Georgia – which is undergoing a transfer of power after its recent parliamentary elections.

Kakabadaze will also discuss how the network played an integral part in his successes as a scholar.
