SAN DIEGO – Citizens' Oversight Project activist Raymond Lutz asked the Nuclear Regulatory Commission Wednesday to hold a formal hearing on changes to Southern California Edison's license for the San Onofre Nuclear Power Plant.
Before a panel of lawyers and board members at the NRC headquarters in Maryland, Lutz appeared via video conference and argued the changes to the frequency of hundreds of inspections would keep the public out of the loop.
"Edison wants to try to keep hearings from happening and that makes it so the public cannot watch them," said Lutz. "They want to run the plant the way they want."
Lawyers from the NRC staff and Edison argued against a hearing. They said Lutz missed the deadline to file and they also argued Lutz has no right to demand a hearing because he doesn't live near the plant.
"Citizens' Oversight has not provided any affidavits from those who live within 15 minutes of the plant," said Edison's attorney Steven Frantz.
Edison's attorney also argued the change was meant to give Edison more flexibility in order to run the plant more efficiently. Lutz disagrees.
"But this means the NRC doesn't get reports if they change it and the NRC doesn't get to regulate," said Lutz
The NRC board is expected to make a decision in January whether to grant a full hearing on the changes.

The Nuclear Regulatory Commission's Atomic Safety and Licensing Board heard a request Wednesday regarding Southern California Edison's operating license for the San Onofre nuclear power plant.
It was a lesson in fighting city hall — or, in this case, the Nuclear Regulatory Commission.
An activist engineer from Southern California tried Wednesday to convince the NRC's Atomic Safety and Licensing Board to hold a formal hearing on changes to Southern California Edison's operating license for the San Onofre nuclear power plant. The Commission did not go easy on Edison.
Inside the Maryland hearing room at commission headquarters, it was a sea of suits — lawyers, nuclear engineers, and NRC board members.
Back in California, appearing via videoconference, activist Ray Lutz said amendments to San Onofre's license would allow Edison to change the frequency of hundreds of critical inspections, hiding them in documents controlled by the utility company.
"No public review, no opportunity for a hearing, no checking that anything is going right," said Lutz, pointing out the potential for mistakes. "It helps to have the public reviewing this stuff."
Lawyers for both the NRC staff and Edison argued against scheduling a full hearing, saying Lutz missed the deadline to file paperwork and had no standing to demand a hearing since he lives in El Cajon — too far away to be affected by safety issues at the plant.
Edison attorneys insisted changes in surveillance frequency would still be subject to oversight. But Alex Karlin, an administrative law judge on the Atomic Safety and Licensing Board, pointed out to Edison attorney Steven Frantz that under the amended operating license, the utility would no longer be required to report changes to the NRC. Karlin kept asking whether that results in a relaxation of oversight. "Yes or no?" he asked several times.
Frantz said the change was meant to give a licensee more flexibility: "That's the whole purpose."
Karlin kept pushing. Finally, Frantz agreed, saying, "Yeah, we are no longer required to get NRC approval."
The NRC board will decide in January whether to grant a full hearing on changes to Edison's operating license for San Onofre.
Separately, the NRC is also reviewing Edison's proposal to restart one of the reactors at the nuclear plant, which has been offline since January.

Raymond Lutz, Electrical Engineer and Founder of Citizens Oversight, prepared the petition to intervene based on a review of the proposed changes to the operating license of San Onofre. The proposed changes to the license do not directly reflect on the recent emergency shutdown on January 31, 2012, and furthermore, is not in response to the proposal by SCE to operate San Onofre Unit 2 at a lower power level despite massive and severe damage to the steam generator tubes due to excessive vibration.
Instead, the proposed license amendment makes a large number of changes throughout the technical specifications of the operating license. Most of these changes are quite similar in nature: they remove explicit requirements for inspections from the operating license and move these to a separate document which is no longer under the control of the NRC, but is under the control of the licensee, and therefore, it can be changed "at will" by SCE without any notice to the public, opportunity to intervene or request a hearing.
Citizens Oversight believes these changes unnecessarily obfuscate the specification and puts inappropriate trust in the licensee to keep the inspections at a safe level. They rely on the Surveillance Frequency Control Program (SFCP) which utilizes Probability Risk Assessment (PRA) calculations using a set of preconceived failure modes. Such analyses are subject to well understood knowledge-based failure mechanisms of "overconfidence" and limited failure scenarios known to underestimate the variety of failure mechanisms.
An argument will be made by SCE attorneys that the specifications of surveillance frequencies have not changed, since the values of maximum time period between inspections will initially be the same. But under the proposed changes, the licensee can vary these periods without any review by NRC or the public thereafter, and there are no "not-to-exceed" values specified in the specification. Furthermore, moving these values to another document obfuscates actions required by the licensee and may induce operator error as workers search for the correct value in multiple documents.
COPS also objects to many other changes proposed, including allowed leakage from the steam generators into the atmosphere, the fact that the isolation area around the plant is not enforceable, and numerous specification mistakes.
To the knowledge of COPS, no other organization is actively objecting to the license amendment request.
COPS requested that the event be held near San Onofre, but they refused to hold it so that local residents can attend, although the proceeding will be open to the public in Maryland, and SCE attorneys and NRC staff will be attending in person. COPS representatives will be attending the meeting using a video- conferencing link with details to be determined, and although the NRC is not accommodating participation by the public, COPS is grateful to the World Resources SimCenter for working with us to set up a viewing room nearby, as well as hosting the Press Conference before, and Q&A after.

UNAC applauds the will of the Palestinians to survive and to thrive and to maintain the optimism that one day Palestine will be free. In spite of daily hardships and repression (80% need food aid; 45% unemployed) - intensified as collective punishment for democratically voting for Hamas in 2006, and still trying to rebuild after the genocidal bombardments of "Operation Cast Lead" in 2008-09 - the Palestinians cling to their ancient land and continue to resist. As spoken word artist Rafeef Ziadah says, we don't teach our children hate; "we teach life!" A ceasefire between Israel and Gaza has been announced after eight days of Israel's latest assault on the Palestinians held captive in the world's largest penal colony. More than 160 Palestinians, including dozens of children, women and elderly, have been killed and more than 1,100, also mainly civilians and children, have been injured. Civilians and vital infrastructure have been deliberate targets, along with journalists attempting to counter the claim of Israel's simply "defending itself". While a halt in the current escalation is good news, it is only a temporary respite as long as the underlying cause is not resolved. The long-term issue is that Gaza remains under a brutal occupation and blockade and the violence before and after "ceasefires" is ongoing, with killings often unreported. There is a long history of ceasefire agreements, honored by the Palestinians, but broken by Israeli targeted assassinations and killings. There is also the harm that is done because Israel restricts food and medicines, contaminates the water, destroys infrastructure, and steals land. Generations of Palestinian children have been traumatized by Israeli violence with crippling impact; food scarcity and restrictions cause malnutrition and widespread growth-stunting anemia. The war crimes committed by Israel are in full partnership with the United States. $3.1 billion dollars of U.S. taxpayers' money goes to Israel annually to sustain its illegal and brutal occupation of the Palestinians living under an apartheid, militarized regime and to threaten Iran. The money is used to buy American weaponry. In the past 10 years, almost 671 million U.S. weapons valued at $18,866 billion were delivered. In addition to full military and economic support, the U.S. uses its diplomatic power to shield Israel from the demands of the international community to adhere to international law and from any accountability. The recent assault on Gaza immediately followed three weeks of joint military exercises involving thousands of U.S. and Israeli military personnel and costing more than $100 million. Part of the mission was to test the Iron Dome missile defense system paid for by the U.S. government, costing hundreds of billions of dollars. Wanting to test these systems in real life may have been one of the reasons for the deliberate triggering of the operation. "Make no mistake. The U.S. is 100 percent committed to the security of Israel. That commitment drives this exercise," said U.S. Air Force Lt. Gen. Craig Franklin. "These are very difficult days [which require] further bilateral cooperation in defense against future missile threats, as well as persistent operations against Hamas and the Iranian terror threat in Gaza, which is likely to intensify and expand," Israeli Defense Minister Ehud Barak told reporters. Both the U.S. and Israeli officials agree on this "partnership". The Obama administration was briefed just prior to the attack showing that this was a jointly orchestrated operation. According to Israeli Defense Minister Ehud Barak, "This effort (attack on Gaza) could not have been concluded without the generous and consistent support of the American administration, led by President Obama." President Obama likewise stated that the U.S. is "fully supportive of Israel's right to defend itself" and the U.S. House of Representatives passed a resolution expressing its "unwavering commitment" to Israel. At UNAC's founding conference in 2010, there was a debate about what position to take re: Palestine, Israel, and the U.S. For the first time, a large and representative gathering of peace and social justice activists took an unequivocal stand in solidarity with the Palestinians. By a strong majority vote, the conference adopted the demand that the U.S. end all aid to Israel – military, economic, and diplomatic -- and joined the BDS campaign against Israel. This represented a turning point for the American left and we are proud to have played a role in moving the struggle forward. FREE PALESTINE! 11-28-12
