This is the 100th anniversary of the San Diego Free Speech Fight, when city council prohibited soapbox oration centered at Fifth and E streets in the Stingaree District (Gaslamp). Prosecutors charged those arrested on felony charges of conspiracy, and police brutality was common. The Free Speech League sought to bring the cases up to jury trials to clog the system. There were an estimated 5,000 involved in one protest, with 41 arrested. The views of the Free Speech movement were similar to Occupy, on the wealth divide, worker's rights and later on, First Amendment rights. The circumstances of the movement are echoed today. Vigilantes would take Wobblies trying to go south to San Diego off the trains.

"1938:  A Year in the Life of Three Women, Anarchists, Prostitutes," performed by Dr. Emily Hicks and "The Wobblies," a film screening and discussion.

Emily Hicks and Rocio Weiss in front of "Fear is the Guardian of Ignorance" screen, "Border Axes" exhibition, at the Capp St. Project (San Francisco).  This was taken in 1989 when Weiss and she were members of BAW-TAF (the Border Art Workshop).  It contextualizes one aspect (in addition to the free speech fights exhibition) of the performance at the Centro (by making a link to the Border Art Workshop, which was based at the Centro).

Travelers to Cuba and music lovers are familiar with the song "Guantanamera"— literally, the girl from Guantánamo. With lyrics by José Martí, the father of Cuban independence, Guantanamera is probably the most widely known Cuban song. But Guantánamo is even more famous now for its U.S. military prison. Where "Guantanamera" is a powerful expression of the beauty of Cuba, "Gitmo" has become a powerful symbol of human rights violations—so much so that Amnesty International described it as "the gulag of our times."

 

That description can be traced to January 2002, when the base received its first 20 prisoners in shackles. General Richard B. Myers, chairman of the Joint Chiefs of Staff, warned they were "very dangerous people who would gnaw hydraulic lines in the back of a C-17 to bring it down."  We now know that a large portion of the 750 plus men and boys held there posed no threat to the United States. In fact, only five percent were captured by the United States; most were picked up by the Northern Alliance, Pakistani intelligence officers, or tribal warlords, and many were sold for cash bounties.

 

The Guantánamo story starts in 1903, when the U.S. Army occupied Cuba after its war of independence against Spain. The Platt Amendment, which granted the United States the right to intervene in Cuba, was included in the Cuban Constitution as a prerequisite for the withdrawal of U.S. troops from the rest of Cuba. That provision provided the basis for the 1903 Agreement on Coaling and Naval Stations, which gave the United States the right to use Guantánamo Bay "exclusively as coaling or naval stations, and for no other purpose."

 

In 1934, President Franklin D. Roosevelt signed a new treaty with Cuba that allows the United States to remain in Guantánamo Bay until the U.S. abandons it or until both Cuba and the United States agree to modify their arrangement. According to that treaty, "the stipulations of [the 1903] agreement with regard to the naval station of Guantánamo shall continue in effect." That means Guantánamo Bay can be used only for coaling or naval stations. Additionally, article III of the 1934 treaty provides that the Republic of Cuba leases Guantánamo Bay to the United States "for coaling and naval stations." Nowhere in either treaty did Cuba give the U.S. the right to utilize Guantánamo Bay as a prison camp. 

 

It is no accident that President George W. Bush chose Guantánamo Bay as the site for his illegal prison camp. His administration maintained that Guantánamo Bay is not a U.S. territory, and thus, U.S. courts are not available to the prisoners there. But, as the Supreme Court later affirmed, the United States, not Cuba, exercises exclusive jurisdiction over Guantánamo Bay. Amanda Williamson, a spokeswoman in the Red Cross' Washington office, noted that prisoners at Guantánamo "have been placed in a legal vacuum, a legal black hole." Amnesty International went further, noting an obvious gap between U.S. rhetoric and practice: "Given the USA's criticism of the human rights record of Cuba, it is deeply ironic that it is violating fundamental rights on Cuban soil, and seeking to rely on the fact that it is on Cuban soil to keep the U.S. courts from examining its conduct."

 

Although the Convention Against Torture, a treaty the United States has ratified, forbids the use of coercion under any circumstances to obtain information, prisoners released from Guantánamo have detailed assaults, prolonged shackling in uncomfortable positions, sexual abuse, and threats with dogs. Mustafa Ait Idr, an Algerian citizen who was living in Bosnia when he was sent to Guantánamo, charged that U.S. military guards jumped on his head, resulting in a stroke that paralyzed his face. They also broke several of his fingers and nearly drowned him in a toilet. Mohammed Sagheer, a Pakistani cleric, claimed the wardens at Guantánamo used drugs "that made us senseless." French citizen Mourad Benchellali, released from Guantánamo in July 2004, said, "I cannot describe in just a few lines the suffering and the torture; but the worst aspect of being at the camp was the despair, the feeling that whatever you say, it will never make a difference."  Benchellali added, "There is unlimited cruelty in a system that seems to be unable to free the innocent and unable to punish the guilty."

 

Australian lawyer Richard Bourke, who has represented many of the men incarcerated at Guantánamo, charged that prisoners have been subjected to "good old-fashioned torture, as people would have understood it in the Dark Ages." According to Bourke, "One of the detainees had described being taken out and tied to a post and having rubber bullets fired at them. They were being made to kneel cruciform in the sun until they collapsed." Abdul Rahim Muslimdost, an Afghan who was released from Guantánamo in April 2005, said he suffered "indescribable torture" there.

 

U.S. and international bodies have verified reports of torture and abuse. Physicians for Human Rights found that "the United States has been engaged in systematic psychological torture of Guantánamo detainees" at least since 2002. FBI agents saw female interrogators forcibly squeeze male prisoners' genitals and witnessed detainees stripped and shackled low to the floor for many hours. In February 2006, the United Nations Human Rights Commission reported that the violent force-feeding of detainees by the U.S. military at Guantánamo amounts to torture. 

The very existence of the Guantánamo prison camp harms America's international reputation. A January 2005 editorial in Le Mondeconcluded, "The simple truth is that America's leaders have constructed at Guantánamo Bay a legal monster." Moreover, it has created more enemies of the United States. Writing for the New York Times, Somini Sengupta maintained that Guantánamo Bay has been a setback in the war on terror insofar as it has "emerged as a symbol of American hypocrisy."  

The list of Guantánamo critics is a long one. Archbishop Desmond Tutu dubbed it a stain on the character of the United States. Former U.N. Secretary General Kofi Annan said the United States must close the camp as soon as possible. The Economist called for the facility to be dismantled, described the treatment of the prisoners there as "unworthy of a nation which has cherished the rule of law since its very birth," and claimed it "has alienated many other governments at a time when the effort to defeat terrorism requires more international co-operation in law enforcement than ever before."  The National Lawyers Guild, Association of American Jurists, Inter-American Commission on Human Rights, and Amnesty International have all called for closing the prison camp and releasing or charging prisoners with criminal offenses in accordance with international legal norms. 

In addition to legal and political problems with Guantánamo, there are enormous human costs to consider. Attorney Joseph Margulies has been to death row in six states and watched his client be executed. But as he noted, "I have never been to a more disturbing place than the military prison at Guantánamo Bay. It is a place of indescribable sadness, where the abstract enormity of 'forever' becomes concrete: this windowless cell; that metal cot; those steel shackles."

Indeed, Army Col. Terry Carrico, the first warden at Guantánamo, complained that when he was there, the men were held in "basically outdoor cages," adding, "It's what you would normally find in a veterinarian's facilities to hold animals." Carrico said "very few" of the men imprisoned during his tenure had useful intelligence. He favors closing Guantánamo, but doubts that will ever happen.

President Barack Obama said a year ago that he was committed to closing Guantánamo because it was a symbol that was "probably the No. 1 recruiting tool" on terrorist websites. But Obama signed the National Defense Authorization Act (NDAA), which bars any transfer of detainees to U.S. prisons, even for trial. The act also restricts the President's authority to transfer detainees to other countries. Of the 171 men remaining at Guantánamo, 89 have been cleared for release by a review conducted by the CIA, FBI, military, and Department of Homeland Security. But those men will likely die at Guantánamo because Obama refused to put the brakes on Congress's use of the issue as a political football in the NDAA.

In a recent op-ed in The New York Times, Harvard lecturer Jonathan M. Hansen wrote, "It is past time to return this imperialist enclave to Cuba," adding, "It has served to remind the world of America's long history of interventionist militarism."

Obama should heed Hansen's words. For the abiding presence of the Guantánamo gulag is not simply illegal and immoral. It also continues to be a symbol of U.S. hypocrisy, and makes us a target for more terrorist attacks.

San Diego Occupiers stranded last night in Amarillo were back on the road to D.C. at 5:40 a.m. this morning on another Greyhound bus. At this point, lease call 800-442-8480 on MONDAY, to complain to Greyhound about the treatment of the Occupiers. Thank you to all of you who responded last night!

From Michael All-In Ponsler: "Don Ainsworthy, Greyhound's most psychotic driver really screwed up tonight. This man was completely rude to all passengers waiting to board and when he saw our Occupy logos he made several negative comments. Once we were on the bus this guy began shouting at people to sit down and shut up. This did not go over well with any of the passengers, but I made it clear that we will not be treated so disrespectfully. He then came back and told me to get off the bus. I refused. The driver exited the bus, locked us in the bus for over an hour while he called the police. Police officers boarded the bus and agreed that the driver was being inappropriate. Surprisingly, the police attempted to negotiate on our behalf. The driver refused to allow us to stay on board and demanded that all the occupiers be removed. Of course, the police officers were required to support his "authority". We are stuck in Amarillo, TX until hopefully the next bus at 5:50 am. If you
care about people being discriminated against based on anything including political opinion call Greyhound corporate (not the Amarillo station) and let them know Don Ainsworthy must be removed from his position with Greyhound. The local Greyhound desk staff and baggage handlers confirmed that this man is complained against repeatedly. The police also said they are here to remove passengers far too often and almost always due to this particular driver's attitude."

If you can volunteer a few hours to help gallery sit for the Free
Speech exhibition at the Centro, email me your availability:
organizations, your members.* Open hours, Tues - Sundays, noon -
4:00pm and by special appointment. Show closes Feb. 12.

During the past decade, this writer has remained skeptical about prospects of a US-supported war against Iran. The potential costs outweighed the benefits. Now, as the 2012 election year unfolds, I am not certain. The political and geo-political dynamics underscore the growing threat of war. 
 

It's not that Barack Obama wants an airstrike against Iran, whether by the Israelis, the Americans, or the Israelis with covert US support. My respected friends Juan Cole and Mark Weisbrot are not so sure. They think Obama is laying the groundwork, and may be right. Obama hardly needs another war with unknown costs and consequences. But presidents are not all-powerful, and Obama can be forced to acquiesce unless there is a sharp increase in serious public opposition. As Trita Parsi, director of the National Iranian American Council, told DemocracyNow on January 12:

"We may very well end up in a situation in which, rather than the governments controlling the dynamic, the dynamics will control the government...this could escalate into a full-scale war."

The End of the "Long War" Doctrine

Obama Takes Stand Against Neo-Cons and the Pentagon

With this week's issuance of the Pentagon's new defense strategy, President Obama is ending the "Long War" envisioned by many neo-conservatives, counterinsurgency advocates and Pentagon hawks.

 

While there is much for progressives to criticize in the report-beefing up a cold war in Asia, increased cyberwarfare and secret operations-the striking new departure is the squelching of the Long War concept, projected by theorists like David Kilcullen to last another fifty years following the wars in Iraq and Afghanistan at a cost of trillions in tax dollars and thousands of lives.

 

The Long War has been opposed by some circles of the peace movement for several years, and I have written about it in The Nation and in an op-ed in the Los Angeles Times. However, virtually no attention was paid to the debate in the rest of the mainstream media, public debate or even in much of the alternative media. Instead, the Long War doctrine was advocated in obscure defense think tanks and among intellectual hawks in forums like the Long War Journal, a project of the Foundation for the Defense of Democracies, which claims to receive 12,000 views per day.

The Obama administration is withdrawing the first 10,000 American troops from Afghanistan, with another 23,000 scheduled to withdraw by September 2012 during the height of the national political campaigns. It is understood by many that the Obama administration would like to accelerate the pullout, and transfer the lead combat role to Afghan troops, before the coming election. 
 

In response, many US military and diplomatic leaders, as well as all Republican candidates except Ron Paul, and even Afghan president Hamid Kharzai, are calling loudly for Obama to delay the troop withdraw until some sort of "victory" is secured over the Taliban. The politics of blame is very much in the air.

 

Obama is setting 2014 as the deadline for a massive US troop withdrawal, and a shift to an Afghan lead in combat, while the actual figures remain subject to fierce ongoing contention. The cost of Afghanistan to taxpayers thus far is $450 billion in direct funding, with total direct and indirect projected to be one trillion. In FY 2011 it has cost no less than $118.6 billion, more than double the FY 2008 bill. One thousand eight hundred sixty-two Americans have been killed in Afghanistan and another 15,000 wounded. According to the Department of Labor's latest numbers, US civilian contractor battlefield casualties include 1,115 killed and 14,297 wounded.

Celebrating Participatory Democracy 

 

The first principle of solidarity declared by Occupy Wall Street on September 17, 2011 called for "direct and transparent participatory democracy," recalling the central aim of the 1962 Port Huron Statement, the founding document of Students for a Democratic Society, issued fifty years earlier. All across the world this year, millions of people have demanded direct participation in the decisions affecting their lives.

 

The continuing importance of participatory democracy, its global appearance this year, and its enhanced prospects in the Facebook era, will be the focus of many talks, writings and meetings during this fiftieth anniversary year of the Port Huron Statement.

Judge Real Removed from Alex Sanchez Case

 

Judge Manuel Real.

Judge Manuel Real was removed as presiding judge in the gang conspiracy case involving Alex Sanchez and 17 others by an order of the Ninth Circuit Court of Appeals yesterday.

 

A new judge as well as new attorneys are being assigned to the case, which may be delayed. After being arrested in June 2009, Sanchez was freed on bail by a Ninth Circuit order in January 2010, and has been free while some 17 other defendants remain in custody.

 

The removal of Judge Real is widely and privately applauded by many defense attorneys in Los Angeles because of his reputation for irrationality in the courtroom. His decisions have been reversed on appeal more than any judge now on the federal bench. At one point in October 2009, the judge chastised this writer in the courtroom for publishing an article in The Nation describing Real as "surreal" and suggesting that a fair trial for Sanchez was impossible.

Obama to Order Contribution Disclosures?

President Obama may order the disclosure of $541 billion in campaign contributions by corporations with federal contracts, as a response to secret Super-Pacs and the Citizens United ruling. Such a move would infuriate defense contractors and big corporations and draw a sharp line for the 2012 elections debate.

 

Over 60 House members, led by Rep. Anna Eshoo, have been pushing Obama for months to issue the order. It would be an incendiary step, but would be strongly backed by citizens groups and the mainstream media. The order would be the only initiative exposing the role of money in politics during the election year.

 

In July 2011, Eshoo sent a letter, signed by 62 House Democrats, urging President Obama to issue the executive order. Now, according to Public Citizen, the pressure is picking up.

As Congress moves to authorize the US military to intervene against dissidents at home, it is well to remember the scale of the gulag already bulging with incarcerated terrorism suspects, mostly Muslim, already on permanent lockdown. (New York Times, December 11, 2011)

 

Despite the surreal world of politics, it would appear that the calls for military tribunals and denunciations of civilian courts are wildly inflated for partisan ends. But few if any candidates want to risk being called "soft on terrorism."

Adam Jung is an organizer for Occupy London.

Things are progressing here amazingly. We have had a much larger impact on British society and policy then I think we fully realize. In reality it has been nearly as much luck as organizing.

Ending up occupying on the steps of St. Paul's cathedral after being shoved back from the Stock Exchange created a situation that brought the Church of England to it's knees, prompting massive soul-searching and creating a sense that Occupy London was the new moral voice of the nation. The Church has now fully backed us and I meet with bishops and staff weekly to coordinate the launch of nationwide General Assemblies this March.  

 

I have a lot of hope for what these democratic forums can spur on, and with the backing of the unions, I think we may be able to put the government in a defensive position, and perhaps, eventually, push for the dissolution of the coalition government. A lot of the work we are doing at this time we don't do under the Occupy name.

"No Surprise" We Spy at Home

That the CIA works with local American police departments "should not be a surprise to anyone," says Marie Hart, a public relations staffer with the Agency. 

 

The CIA, which admits to working closely with the New York police department, has opened an internal investigation into allegations of domestic spying "to make sure we are doing the right thing," according to CIA Director David Petraeus. The CIA has embedded a clandestine officer within the NYPD, and the NYPD's intelligence chief, David Cohen, is a former CIA officer.

The pepper spraying of

11 peaceful protesters at the University of California, Davis, provides an opportunity to reopen questions long ignored. Is oleoresin capsicum, the key ingredient of pepper spray, known to be safe? And if so, why have the authorities never performed the health risk assessments that were required by law when the weapon was introduced in 1992? Are they afraid of anything?

 

I was a state senator who worked on the issue when the state's Office of Environmental Health Hazard Assessment was charged with conducting health studies during a three-year period in the 1990s. When the incident last month at UC Davis became a shocking global image, I checked with officials at OEHHA to see if the state has ever done a risk assessment.

 

The straight answer from acting director George Alexeeff last week was no. Not his agency, not the state's Department of Pesticide Regulations, either.
