UCSD ADMINISTRATION PLANS EVICTION OVER THANKSGIVING?


LA JOLLA –  November 21, 2014. On Wednesday, November 19, UCSD administrators decided to seek a writ of possession to enforce an earlier unlawful detainer judgment and evict the CHE Cafe Cooperative and any students from the cafe space it has continuously occupied for over 34 years. Despite a resolution by the UCSD Associated Students Council (AS) asking the Chancellor to not proceed with posting a 5-day notice to vacate, and 14,000-signature petitions and open letters demanding that UCSD stop the eviction actions against the C.H.E. Cafe, delivered to the Chancellor earlier this month, action by the  administration to evict the CHE Cafe continues rather than negotiations for a new lease agreement with the Co-op.
 
When the new Vice Chancellor for Student Affairs, Juan Gonzalez, addressed the UCSD Associated Students Council (AS) on November 5, he told them that the eviction would go forward because the administration had no choice because the court has a concern about the "safety" of the building. The issue of "safety" was not raised in the eviction trial and was not the basis for the court ruling. The administration has not cited any specific legal code to support its public claims of a "safety" problem at the CHE building. The Fire Marshall did the annual C.H.E. Cafe building inspection on April 17, 2014 and wrote up his findings that the building is safe.
 
UCSD Public Records officials said on November 20 that there is no Fire Marshal Report from the April 17, 2014 inspection of the CHE facility that was performed by the Fire Marshal under the supervision of University Center Assistant Facility Director, John Payne. CHE Cafe members were at the UCSD public records office earlier this week to pay for the copies of a large release of UCSD records regarding the Cafe. They say the official told them almost all of the records were ready to hand over, with the exception of the 2014 Fire Marshall's report, which she was still "working on". The CHE members say the official had the Fire Marshall's report up on her computer screen, and that they should have taken a picture of the screen when they saw it!
 
In Payne’s email to the CHE after the inspection he stated: “I wanted to Thank you for all your efforts in keeping the Che Cafe facility safe. The Fire Marshal was extremely pleased at all the efforts that have been made and has signed off on the inspection. Other than 1 minor item in the Darkstar [non-CHE] space the facility is looking good in terms of safety. He will return annually to inspect the facility based on my conversation with him this morning. Once again thank you for all your efforts in keeping a safe facility." All other documents the University is relying upon as to safety and necessary maintenance upgrades are from 2012 or earlier and have been contested and challenged by independently hired engineers and experts.  
 
The Co-ops were hopeful when UCSD Chancellor Pradeep Khosla sat to meet with faculty, expecting negotiations may be moving forward.  Some members of the faculty have publicly warned that using the UC Police Department to force students out of the CHE Cafe could result in violence. All that was offered from the administration was that the University’s deferred maintenance on the CHE Cafe could possibly be funded through a student fee referendum that would also mainly include funding for the University Center’s buildings and programs which are also running huge deficits and in crisis. This is an unreasonable and non-concrete proposal and offer.
 
The CHE Cafe remains flexible and open as to a range of possible solutions that would allow it to continue leasing and operating in the facility. Some alternatives might include allowing the Cooperative to fundraise money and contract for any necessary repairs or safety issues. It could include allowing the space to be shared and co-funded with other entities such as the Craft Center that have been shut down and left empty for the same reason. It could involve the University borrowing or using other funds to start any maintenance which is shown to be immediately necessary. So far, the University has not asserted any safety issue concern is an actual legal or lease violation.  The building has never been "red tagged" (as uninhabitable) and the Co-op's insurance policy remains in full effect.
 
Despite adding so much value to the University and the overall San Diego community the Cafe receives no student fee money for events and costs the University virtually nothing for its programming and is self-sustaining, unlike most University programming. All the University was obligated to pay for under the lease was building and structural maintenance. The University has spent very little over the past 34 years to maintain the structure and now it is attempting to punish and evict the Co-op as a result of its deferral of that structural maintenance.  
 
The 4 UCSD student co-ops were owed several lease extensions but UCSD staff and administrators avoided, stalled and misled students into thinking they were safe under the existing lease and could not be given notice while lease modifications were being negotiated. Now the University has terminated the CHE lease and seeks a forcible eviction.
 
CHE Cafe members and supporters are urging everyone to make phone calls or send emails to faculty and alumni you may know as well as to Chancellor Khosla, Vice Chancellor Gonzales, Legal Counsel Daniel Park’s office and urge the administration to:
 
1-- stop the eviction
2-- stop the false statements and justifications about "safety" issues with the building when the building is perfectly approved and insured to be in operation;
3-- stop threatening students with the use of armed UC police officers and forcible removal from the student fee-funded C.H.E. Cafe building
4-- return to the bargaining table and sign new lease agreements with the C.H.E., the 3 other student-run campus cooperatives, and the Craft Center.

You may know that in 2005, Palestinian civil society issued a call for a campaign of boycotts, divestment and sanctions (BDFS) against Israel until it complies with international law and Palestinian rights.  Across the country this month, organizations are taking actions to urge shoppers to boycott SodaStream products and asking stores to stop selling them.  Stores that carry SodaStream include Target, Office Depot, Staples, Bed Bath & Beyond, and more.  


Background


SodaStream is an Israeli corporation whose main production plant is located in the Mishor Adumim industrial park, part of illegal Israeli settlement in the West Bank. Activists have targeted the corporation for reaping the financial benefit of tax incentives while being complicit in the Israeli occupation of Palestine and violations of Palestinian rights to freedom, justice and self-determination.


Over the last year, a powerful grassroots movement for Palestinian human rights has succeeded in putting the heat on corporatehuman rights violator SodaStream. SodaStream's stocks have fallen dramatically, while Macy's, a major department store in the US has de-shelved their roduct. In October,

SodaStream announced that it would close its factory in the West Bank settlement of Mishor Adumim. However, SodaStream has yet to close its factory in the West Bank, as promised, and has announced plans to open a factory in the Negev/al-Naqab where they would receive more Israeli government subsidies to contribute to the ongoing displacement of Palestinian Bedouins. Palestine solidarity activists have vowed to continue their boycott until SodaStream demonstrates it is no longer benefiting from displacing Palestinians and
abusing their labor.

Equal Time for Torturers?
Networks grant CIA time to spin report

The December 9 release of the executive summary of the Senate Intelligence Committee's report on CIA torture prompted substantial media coverage. But the network newscasts seemed to be guided by the need to apply something like an "equal time" rule for the torturers.

On NBC Nightly News (12/9/14), though correspondent Andrea Mitchell misleadingly referred to "the harsh interrogations now seen as torture"--they were, of course, torture before yesterday--their lead segment adequately summarized the Senate findings.

But then NBC aired a long interview--nearly as long as the report on the Senate's findings--with former CIA (and NSA) director Michael Hayden, who even disputes that the tactics in the report were torture. Anchor Brian Williams told viewers that Hayden was "accused in today's report of providing misleading information in the past."

That's a mild characterization; in fact, as the Washington Post (12/9/14) showed, Hayden's 2007 Senate testimony about CIA torture was revealed to be full of distortions and evasions--from the number of prisoners held by the CIA to his claims that "punches and kicks...have never been employed" and that the "most serious injury" was bruising.

The exposure of Hayden's dishonesty seemed to play no role in NBC's questioning of him, in which he was given ample time to argue that most countries treat their prisoners worse than the CIA does.

After its opening segment describing the Senate findings, CBS Evening News presented a CIA rebuttal report from correspondent Bob Orr, which was a completely uncritical summary of the Agency's dubious claims. Orr goes through the cases where the CIA says torture "worked." He doesn't challenge the Agency's claims, which is an especially strange approach given the Senate report's documentation of how the CIA misled politicians and journalists about its torture program.

But CBS wasn't done. The newscast also aired an interview with Michael Morell, a former CIA deputy director and current CBS News contributor. Pelley made clear that their analyst was "speaking in defense of the CIA." Morrell called the Senate report "deeply flawed." Instead of posing tough questions, Pelley asked him questions like this: "How are CIA officers reacting to this today?"

Did we say "equal time"? Between the CIA rebuttal segment and the Morell interview, CBS Evening News devoted about 50 percent more time to excuses for torture than it did to the torture report itself.

And on ABC World News Tonight, correspondent Martha Raddatz showed that you didn't need to interview a former torture architect to spin the news. Her first words to anchor to David Muir were these: "David, some of these detainees are Al-Qaeda operatives suspected of taking part in the worst terrorist attacks in this country's history." That is true; and some of the prisoners had nothing to do with Al-Qaeda at all--or any kind of militant activity.

After Raddatz's report--which detailed the Senate's findings--the broadcast turned to Jonathan Karl to flesh out the CIA's response. As he told viewers, "The tactics were harsh, but the CIA says it is flat out wrong to say they did not work."

Karl wasn't there to weigh these claims: "One key question: Did the interrogations help get Osama bin Laden? The report says no, the CIA says yes, that only through harsh interrogation did they discover bin Laden's personal messenger."

But no one should take the CIA at its word. As many are pointing out (CNN, 12/10/14Mother Jones, 12/9/14; Firedoglake, 5/3/11), the most important breaks that identified bin Laden's courier came independent of the CIA's torture regime, and the arguments that have been offered for waterboarding's contribution to the search border on the absurd (FAIR Blog, 5/6/11). It's not surprising the CIA would seize on bin Laden to justify torture; the Senate report notes that two days after bin Laden was killed, Hayden went on a talk radio show to boast that the intelligence came from CIA black sites.

The Senate report makes abundantly clear that the CIA went to great lengths to mislead the press, the public and political leaders about its activities. This should not come as a surprise to anyone familiar with CIA history. This is not a time for "balance"--unless journalists truly believe that covering torture means giving torturers an uncritical platform for denying responsibility.

ACTION:
Tell the networks that good journalism means challenging CIA claims--not giving the Agency free airtime to respond to well-documented evidence of torture.

The choking death of Eric Garner by New York City police last July was captured on a cell phone for the world to witness the unnecessary death of yet another unarmed black man who did not resist arrest, his apparent crime was selling individual cigarettes. He died for this crime being choked to death in a need legal stranglehold while crying for help  " I cannot breathe, I cannot breathe..."

Once again a grand jury chose not to indict Ofc. Daniel Pantoleo even though the video showed clearly that his life was not endangered by this unarmed suspect.
"We as a community will not accept the impunity by police officers or the grand jury. We will not accept the murder of an armed, innocent citizens. No more… This is got to stop now!!
